Terms and Conditions of Business

This website is operated by Neocortex Ltd. Registered in England no. 14721555. Registered Office: 42 Winds Lonnen, Seaham SR7 9TG. Where these terms and conditions use terms such as "I", "me", "we", "us" and "our" they refer to Neocortex Ltd. 

 We offer this website, including all the information, tools and services available on it, on the condition that you accept these terms and conditions and the associated privacy policy available on our website. 

By visiting our website and/or purchasing something from us, you are deemed to have accepted these terms and conditions. 

You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions and ensure you understand them before making a purchase.

General Conditions

We reserve the right to refuse service to anyone.

Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices. 

You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website. 

Headings and titles used on this website are done so for convenience only. They do not constitute any part of the terms and conditions and will not limit or otherwise affect the terms herein.

Online Store Terms

Our website offers a range of products and or services for sale. Where we refer to an 'item' we are referring to a single product or service available for purchase on this website. 

We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system. 

Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.

We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks

When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

Your order will only be accepted by us once your goods have been dispatched.

 

Modifications to Our Service and Pricing

Prices for items are subject to change without notice. 

 Prices throught my website are excluding VAT. 

We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you. 

We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.

Delivery

During checkout, you may be presented with one or more options for delivery. Where an estimated timescale for delivery is provided, this is an estimate only and your items may be delayed in being received due to circumstances beyond our control (such as a courier delay, or at busy times).

Dispatch time is 1-3 work days. We usually post on every Tuesday and Friday.

All items are sent in strong packaging. Package may need a signature for delivery.

Estimated delivery times: - United Kingdom: 3-5 business days (Royal Mail 2 Class Tracked and Signed service)

                            - International: 1-8 weeks (International Tracked an Signed Service from Royal Mail, DPD or EVRi)

Delivery Charges

For customers in the United Kingdom:

Royal Mail Standard Second Class from £3.50 P&P

By spending over £50, you will qualify for free delivery (Royal Mail Second Class Service)

For customers outside the UK costs vary depends on destination and chosen service.

By spending over £150, you will qualify for free delivery (International Tracked & Signed Service)

I send parcels worldwide however to be able to print the postal labels recipient's address should including only Latin characters (English alphabet).
Customs and import taxes: As a small business I don’t collect VAT from international customers. The prices on this website are EXCLUDING VAT. International buyers pay VAT and duty on their end, and they should look into what these would be in their country, as they vary.

International buyers (EU customers from 1st July 2021) look into what fees you should expect in your country, before you place your order, becaus we cannot issue a full refund if you refuse import costs in the destination country and return the parcel to us. We can issue partial refund after we got the item(s) back excluding all costs we spent on delivery. If the item isn't returned, or is destroyed, we regret that we cannot issue a refund.

Order Cancellation

If you wish to cancel an order you have placed you must contact us immediately to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us and you will be responsible for paying the cost of returning the items.

Where items have not been dispatched prior to a cancellation request, our refund policy will apply.

Where you have ordered a personalised product or comission work you may not be able to cancel for a full refund.

Return
If for any reason you are not completely satisfied, we will accept return (excluding commission work and personalised product). We can offer full refund (postage include) ONLY when the item is not as described or faulty. Otherwise unfortunately I am unable to refund delivery costs and return delivery costs have to be paid by the customer and must provide proof of postage. Please note: even when an item was offered with free postage I will take postage cost - what I spent to post the item - before I refund.

You have 14 calendar days to return a product from the date you received it.
To be eligible for a return, your product must be unused and in the same condition that you received it.

Refunds
We reserve the right to research the original purchase, and to limit or decline refunds. Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item.

If your return is approved, we will initiate a refund to your credit card (or original method of payment).
You will receive the credit within a certain amount of days, depending on your card issuer's policies.

Because of the nature of these items, unless they arrive damaged or defective, I can't accept returns for:

  • Custom or personalised orders

  • Items on sale

- How can you get compensation for lost parcel -
 If you think your parcel is lost please contact me and I will do my best to help you. 

I send parcels with Tracked & Signed service. That is why I can take responsibility after the courier confirms the parcel is lost.

 

I can take action - making a claim, when the courier treat the item as being lost:

​

Domestic - after 10 working days from estimated delivery date.

International (EU) - after 20 working days from estimated delivery date.

Inetrnational (Rest of the World) - after 25 working days from estimated delivery date. 

 

After I fill the claim form and show supporting evidence, the courier starts an investigation and comes back to me with their response within the next 30 days (90 days for international claims). If they confirms the parcel is lost and they are not able to deliver it to you I can send replacement or issue a refund.

Please note, I can offer replacement or issue a refund only after courier response.

Liability and Indemnity

We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.

Jurisdiction

These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

Entire Agreement

These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.

General

Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howeversoever caused.

Safety

All products made by us for collectors and display purposes. Products should be handled gently.

Products do not carry the CE mark and have not been safety tested.  Products are not suitable for children under 36 months as they may contain choking hazards and small parts.

It is at a parent or carer's discretion whether they deem our products suitable to be played with by older children.

Some of our sourced products are labeled as not suitable for children under 14 years old.  Our handmade products are intended for gentle play and decorative purposes.

We cannot be held responsible for any damage, injuries or accidents that may occur whilst using our products.

Privacy Policy

Information I Collect
To fulfil your order, you must provide me with certain information such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order of jewellery, for example), if you contact me directly.

Why I Need Your Information and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including:
as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;
when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list;
if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services;


Information Sharing and Disclosure
Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:
Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 5 years.

Transfers of Personal Information Outside the EU
I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

Your Rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.
Object. You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
